Abstract: One of the first indications of the intention of the European Community to extend its legislation over the ship-source pollution regime was
implied by the European Commission’s proposal to inaugurate a European Pollution Damage Compensation Fund, under the name of COPE. This initiative met serious obstacles to its endorsement by the member States and did not progress. There have been, however, other developments at the EC level creating synergies with the international regime of ship-source pollution. In this context, recent EC developments on ship-source pollution do not fail to raise a number of issues especially with regard to international maritime law. One of them is whether EC action providing for criminal sanctions in the event of ship-source pollution is antithetical to international norms. At a subsidiary level, the point as to the conformity of the EC action in question to EC legality may also be raised.
